Selling a rental with a tenant still living there is very doable. You just need to know how the lease and Alabama's notice rules shape your timeline.
The Lease Doesn't End Because the House Sells
Selling the property generally doesn't end a tenant's lease. With a fixed-term lease, the new owner usually steps in as landlord and the lease continues until it ends, unless the lease says otherwise. For month-to-month tenants, Alabama law requires at least 30 days' written notice to end the arrangement (Ala. Code § 35-9A-441).
Showings Still Require Notice
You still need to give your tenant at least two days' notice before entering for a showing (Ala. Code § 35-9A-303). Planning showings around that, and being upfront with your tenant, makes the process smoother for everyone.
Two Paths to Consider
- Sell to an investor. A tenant already in place and paying rent is often a selling point for buyers who want a turnkey rental.
- Sell to an owner-occupant. This usually means timing the sale around the lease end, or agreeing on an early move-out with your tenant, sometimes with an incentive.
Neither path is better across the board. It depends on your timeline and which buyers are realistic for your property.
